Please read these Terms & Conditions carefully before using BuraqWash. By creating an account or using our Platform, you agree to be legally bound by these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

By accessing or using BuraqWash ("Platform"), including our website at buraqwash.com, mobile web application and all related services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must discontinue use immediately.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least thirty (30) days before the effective date. Your continued use after the effective date constitutes acceptance of the revised Terms.
These Terms, together with our Privacy Policy, Cookie Policy, Cancellation & Refund Policy, and (for Service Providers) the Service Provider Agreement, constitute the entire agreement between you and BuraqWash LLC.

2. Eligibility

You must be at least eighteen (18) years old and legally able to enter into binding contracts to use BuraqWash.
By creating an account, you represent and warrant that: (a) you are 18 or older; (b) all information you provide is accurate, truthful and complete; (c) you will maintain the accuracy of your information; and (d) your use of the Platform does not violate any applicable law or regulation.
BuraqWash reserves the right to refuse service, terminate accounts, or cancel bookings at our sole discretion if we suspect fraudulent, abusive or unlawful activity.

3. Platform Description

BuraqWash is a technology platform that connects customers with independent professional car washers and home cleaners ("Service Providers"). BuraqWash does not itself perform car washing, detailing or cleaning services.
Service Providers are independent contractors — they are not employees, agents or representatives of BuraqWash. BuraqWash facilitates the connection, booking and payment between customers and Service Providers.
While we vet Service Providers through background checks, identity verification and quality reviews, BuraqWash does not guarantee the outcome, quality or timeliness of any particular service.

4. Account Registration

To use BuraqWash, you must create an account using a valid email address and phone number or through a supported social login (e.g., Google).
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@buraqwash.com of any unauthorised access or use of your account.
BuraqWash will not be liable for any loss or damage arising from your failure to secure your account. One person may maintain only one active customer account.

5. Bookings

When you place a booking through BuraqWash, you are entering into a direct service agreement with the assigned Service Provider. BuraqWash acts as an intermediary to facilitate this transaction.
You must provide accurate and complete information for your booking, including: vehicle details (make, model, colour), service location, property access details (for home cleaning), and any special instructions.
Instant Bookings are confirmed immediately and a Service Provider is assigned as soon as one is available. Scheduled Bookings are confirmed at least two (2) hours before your selected date and time.
We reserve the right to cancel or suspend bookings made with fraudulent, inaccurate or misleading information. Repeated false bookings may result in permanent account suspension.

6. Pricing, Fees & Payment

All prices are displayed in US Dollars (USD) and are inclusive of the service cost. A transparent Platform Service Fee of $4.99 is applied to each booking and is shown separately at checkout.
Payment is processed securely through Stripe. We accept major credit/debit cards. Cash payment may be available in select markets.
The price displayed at the time of booking is the price you pay — prices will not increase after confirmation. However, we reserve the right to update pricing for future bookings at any time.
Tips are optional and 100% of tips go directly to the Service Provider.
If a payment fails, we will attempt to notify you and may suspend your booking until payment is resolved. Unpaid balances may be sent to collections.

7. BW Prime Membership

BuraqWash offers a premium membership programme called BW Prime with three tiers: Gold (10% off all bookings, 1 complimentary wash per month), Platinum (15% off, 2 complimentary washes per month), and Diamond (20% off, unlimited complimentary washes, VIP priority scheduling).
BW Prime memberships are billed monthly on a recurring basis. By subscribing, you authorise BuraqWash to charge your payment method each billing cycle until you cancel.
You may cancel your BW Prime membership at any time from your account settings. Cancellation takes effect at the end of the current billing period — no partial refunds will be issued for unused days.
Complimentary washes included in your membership are non-transferable, cannot be redeemed for cash, and expire at the end of each billing cycle (they do not roll over).
BuraqWash reserves the right to modify membership pricing, benefits or tiers with thirty (30) days' advance notice. You may cancel before the changes take effect if you do not agree.

8. Cancellation & Refunds

Our complete cancellation and refund policies are detailed in our Cancellation & Refund Policy page. Key provisions include:
Free Cancellation: Cancel free of charge if more than two (2) hours before the scheduled service time.
Late Cancellation Fee: Cancellations made between thirty (30) minutes and two (2) hours before the scheduled time incur a $15 cancellation fee.
No-Show / Last-Minute Cancellation: Cancellations made less than thirty (30) minutes before the scheduled time, or if you are not available when the Service Provider arrives, will be charged the full service amount.
Service Provider Cancellation: If a Service Provider cancels your booking, you will receive a full refund or priority rebooking at no additional cost.

9. Service Quality Disputes

BuraqWash is a technology platform that facilitates connections between customers and independent Service Providers. BuraqWash does not perform, guarantee or warrant the quality, outcome or timeliness of any service. All services are provided solely by independent Service Providers.
If you are dissatisfied with the quality of a car wash or home cleaning, you may report the issue through the Platform within twenty-four (24) hours of service completion. BuraqWash will facilitate communication between you and the Service Provider to attempt resolution.
The Service Provider is solely responsible for the quality of their work. Any re-service, compensation or refund is the obligation of the Service Provider, not BuraqWash. BuraqWash may, at its sole discretion, facilitate a resolution but is under no obligation to provide financial compensation.
Quality dispute reports must include: your booking ID, a description of the issue, and photographic evidence where applicable.
BuraqWash reserves the right to take action against Service Providers who consistently receive quality complaints, including suspension or permanent deactivation from the Platform.

10. Damage & Liability

BuraqWash is a technology platform only and does not accept liability for any damage to your vehicle, property or belongings caused by a Service Provider during the performance of a service. All Service Providers are independent contractors who are solely responsible for their own actions, negligence and the consequences of their work.
All Service Providers on BuraqWash are required to maintain their own general liability insurance as a condition of using the Platform. Any damage claim must be directed to the Service Provider and/or their insurance carrier.
BuraqWash may, at its sole discretion, facilitate communication between you and the Service Provider to help resolve a damage dispute, but BuraqWash has no obligation to compensate, reimburse or pay for any damage.
To report damage, you must: (a) notify us within two (2) hours of service completion; (b) provide photographic or video evidence of the damage; (c) provide evidence of the item's condition before the service (where available); and (d) cooperate with any investigation.
BuraqWash reserves the right to suspend or deactivate Service Providers who are the subject of verified damage claims. This action does not create any financial liability for BuraqWash.
BuraqWash expressly disclaims all liability for: property damage, vehicle damage, personal injury, lost or stolen items, pre-existing damage, and any consequential, indirect or incidental damages arising from services performed by Service Providers.

11. User Responsibilities

As a customer, you agree to:
(a) Provide safe, legal and reasonable access to your vehicle or property for the Service Provider to complete the booked service.
(b) Ensure your vehicle or property does not contain hazardous, illegal, dangerous or biohazard materials.
(c) Remove or secure all valuables and personal belongings before the service. BuraqWash is not liable for lost, stolen or damaged personal items left in the vehicle or property.
(d) Not harass, threaten, discriminate against or abuse any Service Provider — verbally, physically or through the Platform.
(e) Not use the Platform for any illegal, fraudulent or unauthorised purpose.
(f) Not attempt to circumvent the Platform by engaging Service Providers directly for services outside of BuraqWash.
(g) Keep your account credentials confidential and notify us immediately of any unauthorised access.

12. Service Provider Relationship

Service Providers on BuraqWash are independent contractors. Nothing in these Terms creates an employment, partnership, joint venture or agency relationship between BuraqWash and any Service Provider.
Service Providers set their own schedules, choose which jobs to accept, provide their own equipment and supplies, and control the manner and method of performing services.
BuraqWash does not control, direct or supervise Service Providers in the performance of their work. For the complete terms governing the Service Provider relationship, please see the Service Provider Agreement.

13. Promotional Codes & Gift Cards

BuraqWash may offer promotional codes, referral credits or gift cards from time to time. These are subject to the following conditions:
Promotional codes are for single use only (unless stated otherwise), are non-transferable, cannot be combined with other offers, and have no cash value.
BuraqWash reserves the right to modify, suspend or cancel any promotion at any time without prior notice if we detect abuse, fraud or technical errors.
Referral credits are earned when a referred user completes their first booking and are applied automatically to your next booking. Referral abuse (self-referrals, fake accounts) will result in forfeiture of all credits and potential account suspension.

14. Intellectual Property

All content on the BuraqWash Platform — including but not limited to the name, logo, brand identity, website design, user interface, source code, text, graphics, images, videos and marketing materials — is the intellectual property of BuraqWash LLC and is protected by US and international copyright, trademark and other intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our intellectual property without prior written consent from BuraqWash.
You grant BuraqWash a non-exclusive, royalty-free, worldwide licence to use, reproduce and display any content you submit through the Platform ("User Content"), including reviews, ratings, photos and feedback, for the purpose of operating and promoting the Platform.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BURAQWASH LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.
BURAQWASH'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE PLATFORM SERVICE FEE ($4.99) PAID FOR THE SPECIFIC BOOKING IN DISPUTE.
BURAQWASH IS A TECHNOLOGY PLATFORM ONLY. WE DO NOT PERFORM SERVICES, EMPLOY SERVICE PROVIDERS, OR CONTROL THE MANNER IN WHICH SERVICES ARE PERFORMED. ALL LIABILITY FOR SERVICE QUALITY, PROPERTY DAMAGE, PERSONAL INJURY, OR ANY OTHER CLAIM ARISING FROM THE PERFORMANCE OF SERVICES RESTS SOLELY WITH THE INDEPENDENT SERVICE PROVIDER.
BuraqWash is not liable for: delays or failures caused by weather, traffic, natural disasters, pandemics or other force majeure events; actions, omissions, negligence or misconduct of Service Providers; damage to vehicles, property or belongings; personal injury; pre-existing damage; lost or stolen items; or interruptions to the Platform caused by technical failures, maintenance or cyberattacks.

16. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
BuraqWash does not warrant that: (a) the Platform will be available at all times without interruption; (b) the Platform will be free of errors, viruses or defects; (c) any results obtained through the Platform will be accurate or reliable; or (d) any Service Provider will meet your specific expectations.

17. Indemnification

You agree to indemnify, defend and hold harmless BuraqWash LLC, its members, managers, officers, employees, agents, affiliates and licensors from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) Your use of or access to the Platform;
(b) Your violation of these Terms or any applicable law;
(c) Your violation of any third-party rights, including intellectual property, privacy or publicity rights;
(d) Any content you submit through the Platform;
(e) Your interaction with any Service Provider.

18. Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Informal Resolution First: Before initiating any formal dispute process, you agree to contact BuraqWash at legal@buraqwash.com and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration: If the dispute cannot be resolved informally, you and BuraqWash agree that any dispute, claim or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
Arbitration shall be conducted in Los Angeles County, California, or at another mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgement in any court of competent jurisdiction.
CLASS ACTION WAIVER: YOU AND BURAQWASH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@buraqwash.com within thirty (30) days of creating your account. Opting out will not affect any other provision of these Terms.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles.
For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

20. Termination

You may terminate your account at any time by contacting support@buraqwash.com or through your account settings.
BuraqWash may suspend or terminate your account at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the safety of our community.
Upon termination: (a) your right to use the Platform ceases immediately; (b) any pending bookings may be cancelled; (c) any outstanding payment obligations survive; and (d) provisions that by their nature should survive termination (including Sections 14-19) will continue in full force.

21. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

22. Entire Agreement & Waiver

These Terms, together with the Privacy Policy, Cookie Policy, Cancellation & Refund Policy and Service Provider Agreement (where applicable), constitute the entire agreement between you and BuraqWash LLC.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
