This Agreement governs your relationship with BuraqWash as an independent Service Provider (car washer, detailer or home cleaner). Please read it carefully before registering or providing services through our Platform.

1. Introduction & Acceptance
- This Service Provider Agreement ("Agreement") is a legally binding contract between you ("Service Provider", "you" or "your") and BuraqWash LLC ("BuraqWash", "we", "us" or "our"). It governs your access to and use of the BuraqWash platform as an independent service professional.
- By registering as a Service Provider on BuraqWash, you acknowledge that you have read, understood and agree to be bound by this Agreement, our Terms & Conditions, Privacy Policy and all other applicable BuraqWash policies.
- If you do not agree to any part of this Agreement, do not register as a Service Provider and discontinue use of the Platform immediately.
2. Independent Contractor Relationship
- You are an independent contractor, NOT an employee of BuraqWash. Nothing in this Agreement creates an employment, partnership, joint venture, agency or franchise relationship between you and BuraqWash.
- As an independent contractor, you: (a) control the manner, method and means by which you perform services; (b) set your own work schedule and availability; (c) have the right to accept or decline any job offered through the Platform; (d) provide your own equipment, tools and supplies; (e) may perform services for other platforms or clients simultaneously.
- BuraqWash does not: (a) control how or when you work; (b) provide you with employee benefits (health insurance, paid leave, retirement contributions, workers' compensation); (c) withhold income taxes from your payments; (d) guarantee a minimum number of jobs or income.
- You are solely responsible for all tax obligations arising from your earnings on BuraqWash, including federal, state and local income taxes, self-employment taxes and any other applicable taxes.
3. Eligibility & Onboarding
- To register as a Service Provider, you must: (a) be at least eighteen (18) years old; (b) be legally authorised to work in the United States; (c) possess a valid government-issued photo ID; (d) pass our background check and identity verification process; (e) have access to reliable transportation to reach customer locations; (f) have the necessary equipment and supplies for your service category.
- Background Check Consent: By applying, you consent to a comprehensive background check, which may include criminal history, driving record (if applicable), identity verification and reference checks. BuraqWash reserves the right to deny or revoke access based on background check results, in accordance with applicable law (including the Fair Credit Reporting Act).
- Onboarding: You may be required to complete an online orientation covering BuraqWash service standards, safety protocols, customer interaction expectations and platform usage.
- BuraqWash reserves the right to accept or reject any applicant at its sole discretion.
4. Service Standards & Quality
- While you control the manner of performing services, you agree to meet the following minimum standards:
- (a) Perform all services professionally, diligently and to the best of your ability.
- (b) Arrive at the customer's location within a reasonable time after accepting a job and promptly update your status in the app.
- (c) Follow the service description and any special instructions provided by the customer.
- (d) Treat all customers, their property and their belongings with respect and care.
- (e) Maintain a clean and professional appearance while performing services.
- (f) Not use the customer's property, vehicle or belongings for any purpose other than performing the booked service.
- (g) Report any pre-existing damage to the customer's property or vehicle through the app before beginning service.
- Failure to meet these standards may result in rating reductions, warnings, temporary suspension or permanent deactivation from the Platform.
5. Equipment & Supplies
- As an independent contractor, you are responsible for providing, maintaining and replacing all equipment, supplies and materials required to perform your services. This includes but is not limited to: cleaning products, towels, vacuums, mops, buckets and personal protective equipment.
- BuraqWash does not reimburse you for equipment, supply or transportation costs unless explicitly agreed in writing.
- All equipment and supplies you use must be safe, non-toxic (where applicable) and suitable for the intended service. You must comply with all applicable health, safety and environmental regulations.
6. Compensation & Payouts
- Revenue Share: For each completed booking, you will receive between sixty-five percent (65%) and seventy-five percent (75%) of the service amount after deduction of the platform service fee ($4.99), depending on your performance tier. BuraqWash retains the remaining twenty-five to thirty-five percent (25–35%) as its platform commission.
- Tips: You receive 100% of all customer tips. Tips are separate from and in addition to your service earnings.
- Payout Schedule: Earnings are accumulated and paid out daily at 7 PM EST via direct deposit to the bank account you provide in your Service Provider profile. You may also request instant payouts (subject to availability and processing fees).
- Payout Method: Payouts are processed through Stripe Connect. You are responsible for ensuring your banking information is accurate and up to date.
- Tax Documentation: BuraqWash will issue IRS Form 1099-NEC to Service Providers who earn $600 or more in a calendar year, as required by law.
- Disputes: If you believe a payout is incorrect, you must notify us within thirty (30) days of the payout date. We will review and correct any verified errors.
7. Acceptance & Cancellation of Jobs
- You have the right to accept or decline any job offered to you through the Platform. There is no penalty for declining a job offer.
- Cancellation by You: If you accept a job and then need to cancel, you must cancel through the app as early as possible. Excessive cancellations of accepted jobs (more than three in a rolling 30-day period) may result in temporary suspension or reduced job priority.
- No-Show: If you accept a job and fail to show up without cancelling, this is treated as a no-show. Repeated no-shows will result in account deactivation.
- Customer Cancellation: If a customer cancels a booking after you have already started travelling to the location, you may be eligible for a partial travel compensation at BuraqWash's discretion.
8. Insurance, Liability & Full Responsibility
- You are solely and fully responsible for all aspects of the services you perform, including but not limited to: service quality, property damage, vehicle damage, personal injury (to yourself or others), lost or stolen items, and any other claim arising from your work. BuraqWash bears no responsibility or financial liability whatsoever for your actions, omissions or negligence.
- Mandatory Insurance: As a condition of using the Platform, you must maintain at all times: (a) general liability insurance with minimum coverage of $1,000,000 per occurrence; and (b) automobile insurance (if you use a vehicle for your work) meeting your state's minimum requirements. You must provide proof of insurance upon request. Failure to maintain adequate insurance may result in immediate deactivation.
- No BuraqWash Coverage: BuraqWash is a technology platform only and does not provide any insurance, damage protection, workers' compensation, health insurance, disability insurance or any other form of coverage or financial protection to Service Providers. You perform all services entirely at your own risk.
- Indemnification: You agree to indemnify, defend and hold harmless BuraqWash LLC, its members, managers, officers, employees and agents from and against any and all claims, demands, lawsuits, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising from or related to: (a) your performance of services; (b) any damage you cause to a customer's property, vehicle or belongings; (c) any injury to yourself, customers or third parties during service performance; (d) your failure to maintain required insurance; (e) your violation of this Agreement, any BuraqWash policy, or any applicable law.
- Damage Claims: If a customer reports damage caused by you, BuraqWash will notify you and facilitate communication. You are solely responsible for resolving the claim, whether through your insurance carrier or directly with the customer. BuraqWash does not compensate customers for damage — that obligation is entirely yours.
- Personal Injury & Accidents: BuraqWash is not responsible for any injury, illness, accident or death that occurs while you are performing services or travelling to/from a job. You assume all risk associated with your work. You are responsible for your own medical expenses, disability and loss of income.
9. Conduct & Safety
- You agree to:
- (a) Not discriminate against any customer on the basis of race, colour, national origin, religion, gender, gender identity, sexual orientation, age, disability, marital status or any other protected characteristic.
- (b) Not engage in any form of harassment, intimidation, threats or violence toward customers, other Service Providers or BuraqWash personnel.
- (c) Not perform services while under the influence of alcohol, drugs or any substance that impairs your ability to work safely.
- (d) Not solicit customers for services outside the BuraqWash platform ("platform circumvention").
- (e) Not share customer personal information with any third party or use it for any purpose other than completing the booked service.
- (f) Comply with all applicable federal, state and local laws and regulations while performing services.
- Violations of this section may result in immediate and permanent deactivation from the Platform.
10. Ratings & Performance
- Customers may rate your service after each completed booking. Your average rating, completion rate and cancellation rate are visible on your profile.
- BuraqWash may use performance metrics to determine job priority, eligibility for premium assignments, and continued access to the Platform.
- If your average rating falls below 4.0 stars over a rolling 90-day period, you may receive a performance improvement notice. Continued low ratings after a notice may result in temporary suspension or deactivation.
- You may dispute a rating that you believe is unfair by contacting support@buraqwash.com within seven (7) days of the rating. BuraqWash will review but is not obligated to remove or modify ratings.
11. Confidentiality
- During and after your use of the Platform, you agree not to disclose or use any confidential information you receive through BuraqWash, including but not limited to: customer personal information (names, addresses, phone numbers), proprietary business information, pricing strategies, compensation structures, and internal communications.
- This obligation survives termination of this Agreement.
12. Platform Circumvention
- You agree not to directly or indirectly solicit, contact or engage any customer you connected with through BuraqWash for the purpose of providing services outside the Platform.
- If BuraqWash determines that you have engaged in platform circumvention, your account will be immediately deactivated and you may be liable for damages including lost commissions.
13. Account Suspension & Deactivation
- BuraqWash may suspend or deactivate your account temporarily or permanently for reasons including but not limited to:
- (a) Violation of this Agreement or any BuraqWash policy;
- (b) Consistently low customer ratings (below 4.0 stars);
- (c) Excessive cancellation of accepted jobs or no-shows;
- (d) Customer complaints regarding safety, conduct or service quality;
- (e) Failed or adverse background check results;
- (f) Fraudulent activity or misrepresentation;
- (g) Platform circumvention;
- (h) Extended inactivity (no completed jobs in 90+ days).
- Suspension: You will be notified of the reason and duration. During suspension, you cannot accept new jobs but may access your earnings history.
- Deactivation: Permanent removal from the Platform. Any pending earnings will be paid out according to the regular payout schedule. You may appeal a deactivation decision by emailing legal@buraqwash.com within fifteen (15) days.
14. Termination
- By You: You may terminate this Agreement at any time by deactivating your account through the app or by emailing support@buraqwash.com. You must complete any in-progress jobs before termination.
- By BuraqWash: We may terminate this Agreement at any time, with or without cause, upon notice to you.
- Effect of Termination: Upon termination: (a) your access to the Platform ceases; (b) any pending earnings will be paid out on the next regular payout cycle; (c) your obligations under Sections 8 (Insurance & Liability), 11 (Confidentiality), 12 (Platform Circumvention) and 17 (Dispute Resolution) survive termination.
15. Intellectual Property
- BuraqWash grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for the purpose of providing services as a Service Provider.
- You may not: (a) use the BuraqWash name, logo or branding without prior written permission; (b) copy, modify, reverse-engineer or create derivative works of any part of the Platform; (c) use the Platform for any purpose other than providing services to BuraqWash customers.
16. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, BURAQWASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM THIS AGREEMENT OR YOUR USE OF THE PLATFORM, INCLUDING LOST PROFITS, LOST EARNINGS, OR LOSS OF BUSINESS OPPORTUNITY.
- BURAQWASH'S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID TO YOU THROUGH THE PLATFORM IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
17. Dispute Resolution & Arbitration
- Any dispute arising from this Agreement shall first be addressed through informal negotiation by contacting legal@buraqwash.com. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding individual arbitration under the American Arbitration Association (AAA) rules, conducted in Los Angeles County, California.
- CLASS ACTION WAIVER: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action, collective action or representative proceeding.
- You may opt out of arbitration by sending written notice to legal@buraqwash.com within thirty (30) days of accepting this Agreement.
18. Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in Los Angeles County, California.
19. Modifications
- BuraqWash may modify this Agreement at any time. Material changes will be communicated via email at least thirty (30) days before the effective date. Your continued use of the Platform after the effective date constitutes acceptance.
- If you do not agree with any modification, you may terminate this Agreement as described in Section 14.
20. Severability & Entire Agreement
- If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force. The invalid provision shall be modified to the minimum extent necessary to be valid.
- This Agreement, together with the Terms & Conditions, Privacy Policy and all other BuraqWash policies, constitutes the entire agreement between you and BuraqWash regarding your participation as a Service Provider.
